1. SERVICE SUPPLIERS
Third parties provide some of the content, goods, and services that are made available on or through a Travel Channel. These parties may include travel suppliers, who may provide services like air travel, hotel, car rental, cruises, and tours (collectively, “Suppliers”), as well as other service providers who work with us on a Travel Channel; these providers are referred to as “Service Providers” in this context. Software, data, and other information that can be found on or given in connection with a travel channel are examples of content that may be copyrighted property of service providers and other third parties. It is against the law for you to alter, duplicate, distribute, transmit, display, publish, sell, license, create derivative works, or use any Content that is made available on or through a Site for public or commercial endeavors.

2. LINKAGE
As a travel agency and provider of a Travel Channel, we function as an independent third party and middleman between you and the Suppliers; your use of our travel services, including, without limitation, a Travel Channel, does not create any joint venture, partnership, employment, agency, representative, or other relationship of a similar nature between you and us or any Service Provider. We help you locate travel suppliers and book specific travel arrangements. When choosing travel providers and suggesting particular itineraries, we take into account a number of variables.

We would like you to know that some of our suppliers give us commissions in addition to rewards for meeting sales targets and other objectives. Occasionally, these suppliers may also give our travel advisors incentives. For various marketing and administrative services we carry out for them, such as giving them access to our marketing channels, having them participate in marketing campaigns, and supporting technology initiatives, some Suppliers may also pay us. Additionally, when customers use their Zenith Emirates Funds® Card, Suppliers pay us a fee. We may occasionally enter into other business agreements with Suppliers; however, these agreements, along with the amounts and kinds of incentives and compensation we receive, are subject to change. When choosing Providers and making itinerary recommendations,

We might take into account a variety of elements, such as your preferences and the availability of the supplier. The Suppliers we find and the itineraries we suggest may also be influenced by our relationships with them. Even though we might suggest certain suppliers and travel destinations, these are just suggestions; you are the only one who can decide which suppliers and travel destinations are appropriate, and we take no responsibility or liability if you are unhappy for any reason with the suggestions we make about suppliers and destinations.

3. TRAVEL CHANNEL USE

You may not use a Travel Channel for any other purposes, including but not limited to making any speculative, false, fictitious, or fraudulent reservation. Instead, you may only use a Travel Channel to make legitimate reservations or purchases for you or other individuals for whom you are authorized to act. It is forbidden to: (i) use a Travel Channel or any content or services offered in conjunction with it for profit; (ii) monitor, scrape, copy, or republish any webpages, data, or content found on a Travel Channel; (iii) “frame,” “mirror,” or otherwise incorporate any part of a Travel Channel; or (iv) use any “robot,” “spider,” or other automatic device, or a program, algorithm, or methodology having similar processes or functionality Use a Travel Channel in violation of or to violate any law, rule, or regulation. (iv) incorporate a Travel Channel (or anything contained therein or provided in conjunction therewith) into any other website or application.

You agree not to use a Travel Channel in connection with any of your activities, nor will you allow anyone who resides, stays, or accesses a Travel Channel from a country that is prohibited by UAE export and/or Office of Foreign Assets Control regulations from using one of these channels. This prohibition includes, but is not limited to, laws based on embargoes, sanctions, or country programs. 

4. BOOKING AND ACQUIRING
You understand and accept that your reservation and/or the purchase of goods and services through a Travel Channel may be subject to additional terms and conditions that are specified by relevant Suppliers and/or Service Providers. You agree to be bound by these terms and conditions, which include, but are not limited to, paying all amounts when they become due and abiding by the terms, conditions, policies, rules, and restrictions that apply to the relevant service provider. You acknowledge that any breach of any of these terms, conditions, policies, rules, or restrictions from the Service Provider—including, but not limited to, timely payment—may lead to the following consequences: (i) you losing any money you paid for the reservation or purchase; (ii) your reservation or purchase being canceled; (iii) you not being able to access any flights, hotels, or other products or services; and (iv) us to deducting from your account any expenses we bear due to this infraction. By using a travel channel, you agree and acknowledge that: (i) suppliers have the right to change prices at any time before you make a reservation or purchase; and (ii) you will be liable for all costs, fees, duties, taxes, and assessments resulting from your use of the travel channel, including (but not limited to) any reservations and purchases you make through it. You understand that prior to using a supplier’s services, some suppliers may require you to sign a liability waiver or other forms. If you refuse to sign these forms, you risk having your reservation(s) canceled, being denied access to the supplier’s services, and losing any money you paid for the reservation(s) to deducting from your account any expenses we bear due to this infraction. By using a travel channel, you agree and acknowledge that: (i) suppliers have the right to change prices at any time before you make a reservation or purchase; and (ii) you will be liable for all costs, fees, duties, taxes, and assessments resulting from your use of the travel channel, including (but not limited to) any reservations and purchases you make through it. You understand that prior to using a supplier’s services, some suppliers may require you to sign a liability waiver or other forms. If you refuse to sign these forms, you risk having your reservation(s) canceled, being denied access to the supplier’s services, and losing any money you paid for the reservation(s).

It’s possible that your purchase or reservation isn’t refundable or cancelable. If allowed, any cancellations or changes are governed by the Suppliers’ policies that you have chosen. The entire cost of the Supplier goods and services that you chose, including taxes and fees, may be charged to your credit or charge card at the time of the reservation or purchase (but not any required hotel fees that might be incurred upon checking out of the hotel). Your credit/charge card statement might show two different charges: one from Zenith Emirates Funds and the other from the Suppliers you chose. If any mandatory hotel fees apply, you must pay them to the property when you check out. The property will also charge you for any additional expenses you incur while visiting, such as but not limited to room service, internet access, parking, and phone calls. Please check with the property for more information as some properties have age restrictions. The products/services that you selected are included in your reservation/purchase; consequently, extra Supplier fees might be charged if baggage, seat preference, or other comparable ancillary items were not included in those products/services. Your flight is not confirmed if you bought it until you receive your ticket. Tickets are non-transferable and cannot have their names changed once they have been purchased. Should they be allowed, modifications to your reservation or purchase are governed by the supplier’s policies. Should you decide to modify your purchase or reservation, you might be charged a change fee equal to the difference in the original fare. If you have made a reservation or purchase from multiple suppliers, and if you need to cancel is approved by one Supplier but not by the other, you will have to cancel your entire trip and not receive a refund for the parts of it that you are unable to cancel. Should cancellation be allowed, there might be a cost associated with it. The terms of the Supplier you have chosen will determine how much the cancellation fee is. You agree to check your reservation, purchase confirmation, and itinerary for accuracy as soon as you receive it, and to notify us right away if there are any errors.

Along with the aforementioned requirements, you also need to have (i) a valid government-issued photo ID, like a driver’s license, and (ii) proof of citizenship, like a passport, in order to make reservations or purchases for cruises. The passenger’s name on the reservation and the name on the documents must match. If you don’t have the necessary paperwork, your request to board will be rejected. The requirements for the cruise you have chosen may differ depending on the supplier and the destination; please get in touch with the supplier. Should you decide to book or buy an air-inclusive cruise package, you understand that: (i) the cruise line you have chosen is in charge of all flight arrangements, including, but not limited to, airline selection, flight routing, and timetables; and (ii) your travel documents, which include the itinerary for your flight, will be sent to you via email or sent to you about two or three weeks before the date of your departure. A public charter may be used to provide some air travel; for more details, see the operator-participant contract included with your travel documents. The cost of flying can vary depending on a number of factors, such as the ship, date and city of departure, class of airfare, availability, and cabin level.

5. RESPONSIBILITY AND AGE
By using a Travel Channel, you warrant and represent that: (i) you are of legal age to use it and to incur binding legal obligations for any liability you may incur from using it; (ii) you will oversee any use of a Travel Channel by minors using your name or account; and (iii) all information you supply, or use using your name or account, in using a Travel Channel, is true, complete, and correct. You acknowledge and agree that certain Suppliers have age requirements and restrictions for using their products and services, and that you are financially responsible for all uses of a Travel Channel made by you and anyone using your name and/or account

Such requirements and restrictions will apply to you and your traveling companions. (iii) In the event that you make a reservation or purchase on behalf of another person, you will be responsible for informing that person of all applicable terms, conditions, policies, rules, and restrictions.

6. NOTICE RELATING TO SUPPLIERS
suppliants are not our employees or agents; rather, they are independent contractors. We are not liable for any acts, errors, omissions, representations, warranties, or negligence on the part of any supplier; we also do not bear liability for any personal injury, death, property damage, loss, accident, delay, irregularity, or other damages or expenses that may arise from such suppliers, whether directly or indirectly. In the event of any delay, cancellation, overbooking, alteration of the schedule, stoppage of operations, labor dispute, strike, government actions, acts of war, terrorism, disease, quarantine, weather or other force majeure event, or other cause beyond our direct control, we shall not be liable and shall not pay refunds (EXCEPT WHERE REQUIRED UNDER APPLICABLE CONSUMER PROTECTION LAW).

IF ANY SUPPLIER OR GOVERNMENTAL AUTHORITY ACTS OR OMISSIONS, WE WILL NOT BE LIABLE FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING. It does not imply that we are endorsing or recommending any product or service just because we include it or offer it through a travel channel. ALL CLAIMS ABOUT ANY GOODS OR SERVICES SOLD THROUGH A TRAVEL CHANNEL ARE LIMITED TO CLAIMS MADE AGAINST THE PRODUCTOR AND SERVICE PROVIDER. IN CONNECTION WITH PRODUCTS OR SERVICES PROVIDED BY ANY SUPPLIER THROUGH A TRAVEL CHANNEL, WE HEREBY DISCLAIMS ALL LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES.

YOU HEREBY RELEASE US FROM ANY LIABILITY WITH RESPECT TO ANY ACT, ERROR, OMISSION, INJURY, DEATH, PROPERTY DAMAGE, LOSS, ACCIDENT, DELAY, IRREGULARITY, OR ANY OTHER DAMAGES OR EXPENSES WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, OR OTHERWISE OF SUCH SUPPLIERS.

7. GO TO SPECIFIC LOCATIONS
We strongly advise that you review the most recent travel advisories, warnings, requirements, restrictions, and public health directives issued by the government before making any reservations or actually departing. Travel to some places may carry a higher risk than travel to others.

You understand and agree that you are in charge of figuring out and obtaining the necessary travel documents for both domestic and international travel, adhering to all entry/exit requirements and other governmental travel restrictions that apply to, from, or within your travel destinations, and meeting all travel-related requirements set forth by the supplier, including but not limited to filling out health forms and providing the results of any necessary health tests.

8. NO WARRANTIES: WE AND SERVICE PROVIDERS MAKE NO WARRANTY OF ANY KIND REGARDING A TRAVEL CHANNEL AND ANYTHING PROVIDED ON OR THROUGH A TRAVEL CHANNEL, ALL OF WHICH ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT LIMITING THE GENERALITY OF ANY DISCLAIMERS SET FORTH IN OUR TERMS OF SERVICE. We and the service providers disclaim all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, as well as those arising by statute or otherwise in law. We and the service providers do not guarantee the accuracy, completeness, timeliness, or reliability of any content, data, or information found on or through a travel channel (a large portion of which is provided by the service providers) OR FROM A DEALING OR TRADE USAGE COURSE. The absence of viruses or other harmful components from a travel channel, its servers, or any email sent by us or any service provider is not guaranteed by either of us. THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU SINCE SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES. YOU MAY HAVE SPECIFIC RIGHTS ARISING FROM STATE TO STATE ARISING FROM SUCH WARRANTIES.

9. LIABILITY LIMITATION
The following: WE AND SERVICE PROVIDERS ASSUME NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO OR USE OF A TRAVEL CHANNEL OR YOUR DOWNLOADING OF ANY MATERIALS, INCLUDING, WITHOUT LIMITATION, DATA, TEXT, IMAGES, VIDEO, OR AUDIO FROM A TRAVEL CHANNEL. THIS IS NOT MEANT TO LIMIT ANY LIMITATION OF LIABILITY SET FORTH IN OUR TERMS OF SERVICE. Regardless of whether the liability is based on contract, tort, strict liability, or any other legal theory, in no case will we or any service provider be responsible for any harm, loss, claim, damage, or any particular, exempt, punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits or lost savings) .

Alternatively, any liability that arises from or is connected in any way to (A) the use of a travel channel or content found here, (B) any failure or delay (including, but not limited to, the use of or inability to use any travel channel component for reservations or ticketing), or (C) the performance or non-performance by us or any service provider, even if such party has been informed of the possibility of damages to such parties or any other party. The foregoing limitation may not apply to you because certain states do not permit such limitations on liability.

10. PASSAGE OF PERSONAL INFORMATION
By giving us any personal information via a travel channel, you understand and agree that we may transfer that information across international borders if it’s needed to process it in compliance with our regular business procedures, the law, and any applicable regulations. In order to process or finish the transactions you have requested, we might also provide Service Providers access to your personal information. Please read our Privacy Statement for further details on how we handle your personal data. 11. INDEMNIFICATION
You agree to defend and indemnify us, any Service Providers, and each of our parents, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, causes of action, or demands (including reasonable legal and accounting fees) made by third parties as a result of, caused by, related to, or arising out of your access to and/or use of a Travel Channel, to the extent that the law permits.

13. REFUND FOR CUSTOMERS HARMED BY TRAVEL SUPPLIERS
California Unless the passenger notifies the seller of travel in writing, all monies paid to the seller of travel for services not rendered will be promptly reimbursed to the passenger upon cancellation of the transportation or travel services, provided that the passenger is not at fault and has not cancelled in violation of any terms and conditions previously disclosed and agreed to by the passenger. This clause does not apply in cases where the travel vendor has transferred the customer’s payment to another authorized wholesale travel vendor or carrier without receiving a reimbursement and that other provider is unable to deliver the scheduled transportation or service.

14. RECORD MERCHANT
You acknowledge that Zenith Emirates Funds is not the merchant of record on any reservations or purchases you may make through the Travel Channel with a Supplier or Service Provider (including, without limitation, the OTA described below), with the exception of any non-refundable Zenith Emirates Funds transaction or ticket fees that may be applicable to your reservations or purchases. If there is a charge on your card statement related to a reservation or purchase and it is for a reservation with a Supplier or Service Provider, that Supplier or Service Provider is the merchant of record, even though the charge may appear as Zenith Emirates Funds Travel, AmexTravel.com, or another reference to Zenith Emirates Funds.

15. TRAVEL AGENCY ONLINE
internet-based travel company One of the service providers that we have chosen to give you access to is Expedia, Inc. (“OTA”), a US-based company that allows you to search for and reserve specific travel services. If OTA is the merchant of record for the reservation or purchase, payment must be made to OTA; otherwise, payment must be made to the relevant Supplier.

16. CHANGE
Any of the following could be changed at any time by us and/or Service Providers: (i) a Travel Channel, including removing or stopping any features or content on a Travel Channel; (ii) any fees or charges for using a Travel Channel; and (iii) these Terms. You agree to abide by the terms and conditions that are in effect at the time you use a travel channel going forward.

17. ABILITY TO SEVER
The remaining provisions of these Terms will remain valid and enforceable regardless of whether any part of them is determined to be unlawful, unenforceable, or invalid. We shall not be precluded from enforcing the same or any other provision(s) in the future by our inability or delay in doing so.

18. CONFIRMATION
The parties to these Terms agree that any and all disputes, claims, or controversies arising out of or related to these Terms (“Claims”) shall be subject to the dispute resolution section set forth in the Cardmember Agreement for the aforementioned Card used. This is especially true if any party used a Zenith Emirates Funds Card to pay, in whole or in part, tentatively or otherwise, for the products and/or services provided for pursuant to this Terms. Resolution of any Claims shall be governed by the terms and conditions set forth in the remaining portions of this Section and the other portions of these Terms, as applicable, to the extent that no Zenith Emirates Funds Card was used, in whole or in part, tentatively or otherwise, for the products and/or services provided pursuant to these Terms.
